PORTER COUNTY
BOARD OF COMMISSIONERS AN ORDINANCE AMENDING PORTER COUNTY ANIMAL ORDINANCE
NO. 96-31 AND THE PORTER COUNTY ANIMAL CODE CHAPTER 6.04-ANIMAL CONTROL CODE
WHEREAS, the
Porter County Board of Commissioners adopted the Porter County Municipal
Code on Tuesday, December 2, 1997 pursuant to Ordinance No. 97-38; and
WHEREAS,
Ordinance No. 96-31, Porter County Animal Control, has been placed in the
Porter County Municipal Code in Chapter 6.04 Animal Control Code; and
WHEREAS, the
Porter County Board of Commissioners has deemed it necessary to amend
Ordinance No. 96-31, Section 7 and Chapter 6.04.07 in the Porter County
Municipal Code as follows:
NOW THEREFORE BE
IT AND IT IS HEREBY ORDAINED THAT:
1. That Section
6.04.070 is amended to read as follows:
6.04.07
Impoundment of animals
G. Any animal
over which an owner has failed to exercise proper care and reasonable
control so as to prevent the animal from becoming a public nuisance. Failure
to restrain shall result in impoundment of the animal after the third (3rd)
violation.
H. Any domestic
animal which has been deemed to be at large so that it is off the premises
of its owner and not under the immediate control of a responsible person
shall result in the impoundment of the animal after the third (3rd)
violation.
2. That Section
6.04.100 is amended to read as follows:
6.04.100 Viscous
animals
B. Upon receipt
of a valid report of a viscous animal, the director is authorized to enter
upon any property where the animal is located, obtain possession of the
animal, and impound the animal at the Porter County Animal Shelter, at the
owner’s expense, until a decision regarding the final disposition of the
animal has been made. The director is further authorized to enter a home to
obtain possession of a viscous animal if the officer is present when the
viscous animal is taken into the home and the officer observed the viscous
animal enter the home.
This ordinance
passed and adopted this 16th day of March, 2010.
