NOTICE OF SUMMONS
TO: Kenneth
Robert Frank, Jr. and/or any other person claiming to a Parental Interest in
the above referenced child. The mother of the child is Destiny Anne Horen.
YOUR ARE FURTHER
NOTIFIED that a petition to terminate the parental rights of the parents of
the named child has been filed against you in the Cobb County Juvenile
Court, and that by reason of an Order for service by publication entered by
the court on the 29th day of January, 2010.
YOU ARE HEREBY
COMMANDED AND REQUIRED to appear before the Juvenile Court of Cobb County,
Georgia, in Marietta, Georgia, on the 18th day of March, 2010 at 9:00
o’clock a.m. The hearing is for the purpose of determining whether the
parental rights should be terminated. The effect of an order terminating
parental rights under O.C.G.A. Title 15, Chapter 11, Article 2 is without
limit as to duration and terminates all the parent’s rights and obligations
with respect to the child and all rights and obligations of the child to the
parents arising from the parental relationship, including rights of
inheritance. The parents whose rights are terminated are not thereafter
entitled to notice of proceedings for the adoption of the child by another,
nor has the parent any right to object to the adoption or otherwise to
participate in such proceedings.
A copy of the
petition to terminate parental rights may be obtained from the clerk of the
Cobb County Juvenile Court, which is located at 1738 County Services
Parkway, Marietta, Georgia 30060-4012, during regular business hours, Monday
through Friday, 8:00 a.m. until 5:00 p.m., exclusive of holidays. A free
copy shall be available to you. Upon request, the copy will be mailed to
you. The child is in the present temporary custody of the Cobb County
Department of Family and Children Services.
The general
nature of the allegations are that the parental responsibilities owed to
said child have effectively abandonment of the child in foster care, and a
sibling of the child previously received gross physical injuries from
non-accidental means.
YOU ARE FURTHER
NOTIFIED that while responsive pleadings are not mandatory they are
permissible and you are encouraged to file with the clerk of this court and
serve upon petitioner’s attorney. Betty Rose Blass, 272 Washington Avenue,
Marietta, Georgia 30060, an answer or other responsive pleading within sixty
(60) days of the date of the order for service by publication.
All concerned
parties are informed that they are entitled to have an attorney represent
them, and if a party requests appointed counsel and qualifies for such
appointment, then the court will appoint counsel at no cost if the party is
unable, without financial hardship, to employ counsel.
