NOTICE OF PLAT COMMITTEE

ACTION AND RIGHT TO APPEAL

The Chesterton Plat Committee hereby gives notice that on September 3, 2010, it gave primary and secondary approval of the Petition of Scott Finner for a three (3) lot subdivision of the following property located in the Town of Chesterton, Porter County, Indiana:

A parcel of land in the Northwest Quarter of Section 5, Township 36 North, Range 5 West of the Second Principal Meridian, Porter County, Indiana, described as follows: Commencing at the Southeast corner of the Northwest quarter of said Section 5, thence North 01 degree 01 minute 36 seconds West, along the East line of said Northwest 1/4 1434.59 feet to the intersection of the East line of said Northwest Quarter and the centerline of Porter Avenue; thence North 89 degrees 44 minutes 48 seconds West along said centerline of Porter Avenue, 713.84 feet (assumed basis of bearings is the East line of the Northwest Quarter of Section 5, Township 36 North, Range 5 West being North 01 degree 01 minute 36 seconds West); thence South 00 degrees 15 minutes 12 seconds West, 50.00 feet to a point on the South right-of-way line of Porter Avenue, said point being the Point of Beginning; thence continuing South 00 degrees 15 minutes 12 seconds West, 159.88 feet; thence North 89 degrees 44 minutes 48 seconds West, 61.43 feet; thence North 59 degrees 53 minutes 26 seconds West, 68.15 feet; thence North 88 degrees 56 minutes 49 seconds West, 106.85 feet; thence South 79 degrees 32 minutes 54 seconds West, 316.47 feet; thence South 85 degrees 44 minutes 56 seconds West, 142.76 feet; thence North 08 degrees 09 minutes 52 seconds West, 220.69 feet to a point on said South right-of-way line of Porter Avenue, said point being the beginning of a non-tangent curve, concave South, having a radius of 2814.79 feet, a chord bearing of North 82 degrees 52 minutes 24 seconds East, and a chord distance of 179.27 feet; thence East along said South right-of-way line of Porter Avenue the following six courses and distances; thence East along said curve 179.30 feet; thence North 84 degrees 41 minutes 54 seconds East 46.09 feet to the beginning of a curve concave South having a radius of 604.81 feet, a chord bearing South 84 degrees 18 minutes 14 seconds East, and a chord distance of 230.76 feet; thence East along said curve, 232.19 feet; thence South 73 degrees 18 minutes 21 seconds East, 14.08 feet to the beginning of a curve concave North having a radius of 622.96 feet, a chord bearing of South 81 degrees 31 minutes 35 seconds East and a chord distance of 178.14 feet; thence East along said curve 178.76 feet; thence South 89 degrees 44 minutes 48 seconds East, 69.75 feet to the Point of Beginning, containing 3.0 acres more or less and subject to all easements and rights-of-way of record.

Interested parties may appeal the approval of the plat pursuant to Indiana Code 36-7-4-708 by filing a written appeal to the Town of Chesterton Plan Commission no later than ten (10) days after the date of the Plat Committee’s action.
