NOTICE TO TAXPAYERS OF BUDGET ESTIMATES

AND TAX RATES

Notice is hereby given the taxpayers of the Indian Boundary Conservancy District located in Westchester Township, Porter County, Indiana, that the Board of Directors of the Indian Boundary Conservancy District will meet at the Brummitt School on Indian Boundary Road, in Westchester Township, Porter County, Indiana, on the 14th day of September, 2010, at 7:00 p.m. and will at that time conduct a public hearing on the proposed 2011 Conservancy District operating budget, tax rate and levy. Thereafter, pursuant to I.C. 6-1.1-17-5, ten or more taxpayers may object to the budget, tax rate, or levy of the Conservancy District by filing an objection petition with the Conservancy District not more than seven (7) days after the aforementioned public hearing. The objection petition must specifically identify the provisions of the budget, tax rate, and levy to which the taxpayers object. If a petition is filed by objecting taxpayers, the Board of Directors of the Conservancy District will consider such objection and will adopt with its budget a finding concerning the objection in the petition and any testimony presented at the adoption hearing. Thereafter, the aforementioned Board of Directors will meet at 7:00 p.m. on the 26th day of October, 2010, at the Brummitt School on Indian Boundary Road in Westchester Township, Porter County, Indiana, to adopt the following budget:

Taxpayers appearing shall have a right to be heard thereon. After the tax rates have been determined and presented to the County Auditor, ten or more taxpayers feeling themselves aggrieved by such rates may appeal to the State Department of Local Government Finance for further and final hearing thereon by filing a petition with the County Auditor on or before the tenth day after publication by the County Auditor of tax rates charged, and the State Department of Local Government Finance will fix a date for hearing in this county.

PROPOSED VARIANCE

Notice is hereby given that the Board of Zoning Appeals of the County of Porter, Indiana, will hold a public hearing on the 15th of September, 2010 at 6:30 p.m. in the Porter County Administration Center, 155 Indiana Avenue, Suite 205, Valparaiso, Indiana, to consider the petition of Keith & Clorresa Carlson, 1068 N. County Line Rd, seeking Variances from the Unified Development Ordinance, Sections 5.04 AS-01: Accessory Structure; General, (F) Placement; and 5.06 AS-03: Accessory Structure; Residential, (C) Appearance, in order to construct a 26’ by 48’ steel pole barn in the front yard of a residence, for the storage of personal property and equipment, in a Rural Residential District, on a parcel located on the following described property:

Parcel 2: Right and easement to go upon, over, across, under and to use the real estate described as follows, to-wit: A strip of land being 60 feet wide in the East Half of Section 12, Township 36 North, Range 5 West of the Second Principal Meridian, in Porter County, Indiana, the centerline of which is described as follows: Commencing at the Northeast corner of said Section 12; thence South 02 degrees 02 minutes 40 seconds East, along the East line of said Section 12, 1425.00 feet to the Point of Beginning for said easement; thence North 88 degrees 20 minutes 33 seconds West, 345.50 feet to a point of curve to the left; thence along said curve, having a chord bearing South 83 degrees 23 minutes 27 seconds West, and a chord length of 236.79 feet and a radius of 823.45 feet to a point of tangency; thence South 75 degrees 07 minutes 27 seconds West, 2101.08 feet to a point on the West line of said East Half of Section 12, said point being the terminus for said 60 foot strip of land;

EXCEPTING THEREFROM: That portion of said 60 foot strip of land falling within the parcel first described above; for the purposes of ingress and egress to and from the parcel described above, as created in that certain Deed dated March 15, 1986 and recorded April 14, 1986, in Deed Record 369, page 278, as corrected by Affidavit of Scrivener’s Error, recorded March 23, 1993, in Miscellaneous Record 137, page 463, made by James A. Gorski, Indiana Registered Land Surveyor.

Subject to roads, highways, ditches, drains, easements, covenants and restrictions contained in all documents of record; all laws, ordinances and governmental regulations including building and zoning; any state of facts that an accurate survey might disclose; and real estate taxes and assessments for 2009 payable in 2010 together with delinquency and penalty, if any, and all real estate taxes and assessments due and payable thereafter which the grantee herein assumes and agrees to pay.
