PROPOSED VARIANCES
Notice is hereby
given that the Board of Zoning Appeals of the County of Porter, Indiana,
will hold a public hearing on the 1st of September, 2010 at 6:30 p.m. in the
Porter County Administration Center, 155 Indiana Avenue, Suite 205,
Valparaiso, Indiana, to consider the petition of Icarus Industrial Painting
& Contracting Co. Inc., c/o Todd A. Leeth, Hoeppner Wagner & Evans LLP, 103
E. Lincolnway, Valparaiso, seeking the following Variance requests from the

Recorder, said corner being the intersection of the centerline of the
vacated O’Connor Street in said Emmetsburg Subdivision, and the Northerly
right-of-way line of State Highway No. 130, as shown on the Plan and Profile
of Proposed State Highway F.A. Project No. 286, Hobart-Valparaiso Road,
sheets 19 and 20, dated Fiscal year 1932; thence South 00 degrees 07 minutes
40 seconds West, along said centerline of the vacated O’Connor Street, a
distance of 91.14 feet to the intersection with the Southerly right-of-way
line of said State Highway No. 130; thence North 50 degrees 03 minutes 09
seconds West, along the Southerly right-of-way, 311.81 feet to the Point of
Beginning; thence continuing North 50 degrees 03 minutes 09 seconds West,
along said right-of-way line, 62.43 feet to Station 534 + 75, being 35 feet
South of centerline, as shown on said Proposed State Highway Sheet No. 20;
thence North 52 degrees 54 minutes 54 seconds West, continuing along said
Southerly right-of-way line, 28.40 feet; thence continuing North 52 degrees

minutes 40 seconds West, along the West line of said Parcel “E”, 274.45 feet
to the Southwest corner of said Parcel “E” and the Northerly right-of-way
line, being 66 feet North of the centerline of the Conrail Railroad,
formerly known as the Pittsburgh, Fort Wayne and Chicago Railroad, as shown
on Station Map for Pittsburgh, Fort Wayne and Chicago Railway, Station 22425
+ 50 to 22478 + 30, dated June 30, 1916; thence South 58 degrees 34 minutes
05 seconds East, along said Northerly right-of-way line, 1087.90 feet;
thence North 31 degrees 25 minutes 55 seconds East 114.62 feet to the point
of beginning.

A parcel of land located at 1651 State Road 130, in Center Township, Porter
County, Indiana.

suggestions to said proposed Use Variance may be filed with the Executive
Director of the Porter County Plan Commission before such public hearing
and/or verbal statements relating thereto will be heard at the
above-designated time and place. A copy of the file is available for public
