ORDINANCE NO 10 09

AN ORDINANCE OF PORTER COUNTY, INDIANA VACATING CERTAIN ALLEYS IN BLOCK 2 IN MALDEN, AS PER PLAT RECORDED DEC. 1, 1902 IN MISCELLANEOUS RECORD “E” PAGE 576 IN THE OFFICE OF THE RECORDER OF PORTER COUNTY, INDIANA.

Whereas, the owners, Jimmy J. Murphy and Nannette M. Murphy; Doris Kloss; Troy Owens and Heather Owens; and Corey J. Upton, of certain real estate have petitioned the Porter County Commissioners for vacation of platted alleys, and,

Whereas, the Porter County Board of Commissioners conducted a public hearing on June 15, 2010 with regard to petition and determined that the platted alleys should be vacated.

NOW, THEREFORE BE IT ORDAINED by the Porter County Commissioners as follows:

1. The following described platted alley, described below as EXHIBIT A, be and is hereby VACATED, and pursuant to law, title shall vest Jimmy J. Murphy and Nannette M. Murphy, the current owners whose real estate is abutting and adjoining the same, free from any right or interest of the public:

EXHIBIT A: Beginning at the S.E. corner of Lot 8 in Block 2 in Malden, as per plat thereof, recorded December 1, 1902 in Miscellaneous Record “E”, page 576, in the Office of the Recorder of Porter County, Indiana; thence N 67º01’01” W, along the South lines of Lots 8, 9, 10, 11 and 12 in said Malden, to the S.W. corner of said Lot 12; thence South, along a Southerly extension of the West line of said Lot 12, 21.72 feet, more or less, to the Northerly Right-of-Way line of the former Chicago & Ohio Railroad, said line also being the Southerly line of an alley lying North of said Right-of-Way line and lying South of the Southerly line of said Lots 8 through 12; thence S 67º01’01” E, along said Right-of-Way line, to the intersection with the Southerly extension of the East line of said Lot 8; thence N 00º01’00” E, along said Southerly extension, 21.72 feet to the Point of Beginning.

2. The following described platted alley, described below is EXHIBIT B, be and is hereby VACATED, and pursuant to law, title shall vest Doris Kloss, the current owner whose real estate is abutting and adjoining the same, free from any right or interest of the public: EXHIBIT “B”: Commencing at the S.W. corner of Lot 3 in Block 2 in Malden, as per plat thereof, recorded December 1, 1902 in Miscellaneous Record “E”, page 576, in the Office of the Recorder of Porter County, Indiana; thence N 00º01’00” E, along the West line of said Lot 3, 27.53 feet to the S.W. corner of the North 6.5 feet of Lot 3 in Block 2 in said Malden, said point being the Point of Beginning for this description; thence continuing N 00º01’00” E, along the West line of Lots 3 and 4 in Block 2 in said Malden to the N.W. corner of said Lot 4 thence Westerly, 16.5 feet, more or less, to the S.E. corner of the North 8 rods of Lot 7 in said Block 2; thence S 00º01’00” W, along the East line of said lot 7, to the S.E. corner of said Lot 7; thence N 67º01’01” W, along the Southerly line of said Lot 7, 70.50 feet to the S.W. corner of said Lot 7; thence S 00º01’00” W, along a Southerly extension of the West line of said Lot 7, 21.72 feet to the Northerly Right-of-Way line of the former Chicago & Ohio Railroad, said line also being the Southerly line of an alley lying North of said Right-of-Way line and lying South of the Southerly line of said Lot 7; thence S 67º01’01” E, along said Right-of-Way line, 79.54 feet, to the intersection with the Southerly extension of the Centerline of the alley lying between Lots 3 and 7 in Block 2 of said Malden; thence N 00º01’00” E, along said Southerly extension, 45.94 feet to the intersection with the Westerly extension of the South line of the North 6.5 feet of said Lot 3; thence Easterly, along said Westerly extension, 8.25 feet to the Point of Beginning.

3. The following described platted alleys, described below as EXHIBIT C, be and is hereby VACATED, and pursuant to law, title shall vest Troy Owens and Heather Owens, and Corey J. Upton, the current owners whose real estate is abutting and adjoining the same, free from any right or interest of the public.

EXHIBIT C: Beginning at the S.W. corner of Lot 3 in Block 2 in Malden, as per plat thereof, recorded December 1, 1902 in Miscellaneous Record “E”, page 576, in the Office of the Recorder of Porter County, Indiana; thence N 00º01’00” E, along the West line of said Lot 3, 27.53 feet to the S.W. corner of the North 6.5 feet of Lot 3 in Block 2 in said Malden; thence Westerly, along the Westerly extension of the South line of said North 6.5 feet, 8.25 feet to the Centerline of the alley lying West of Lot 3 and East of Lot 7 in said Block 2; thence S 00º01’00” W, along said Centerline, 45.94 feet to the Northerly Right-of-Way line of the former Chicago & Ohio Railroad, said line also being the Southerly line of an alley lying North of said Right-of-Way line and lying South of the Southerly line of Lot 3 in said Block 2; thence S 67º01’01” E, along said Right-of-Way line, 152.29 feet, to the intersection with the Southerly extension of the East line of Lot 3 in said Block 2, thence N 00º01’00” E, along said Southerly extension, 21.72 feet to the S.E. corner of said Lot 3; thence N 67º01’01” W, along the South line of said Lot 3, 143.33 feet, more or less, to the Point of Beginning.

4. This Ordinance shall take effect from and after its approval and adoption by the Board of Commissioners of Porter County, Indiana, this 6th day of July, 2010.
