AN ORDINANCE OF
THE
CHESTERTON TOWN
COUNCIL AMENDING
THE CHESTERTON
ZONING MAP
WHEREAS, Porter
County Commissioners, have filed a Petition requesting a change to the
Chesterton Zoning Map for real estate it owns generally located with Highway
49 as its East boundary, Porter Avenue as its North boundary and the
Chesterton Cemetery as its West boundary, in Chesterton, Indiana; and
WHEREAS, the
Chesterton Advisory Plan Commission conducted a public hearing on the
aforementioned rezoning petition on May 19, 2011; and
WHEREAS, the
Chesterton Advisory Plan Commission has certified the rezoning proposal with
a favorable recommendation to the Chesterton Town Council, subject to a
Written Commitment; and
WHEREAS, the
Chesterton Town Council concurs with the recommendation of its Advisory Plan
Commission; and
WHEREAS, the
Chesterton Advisory Plan Commission and the Chesterton Town Council have
paid reasonable regard to the criteria set forth in Ind. Code 36-7-4-603 in
considering the rezoning proposal; and
NOW, THEREFORE,
BE IT AND IT IS HEREBY ORDAINED by the Chesterton Town Council as follows:
SECTION 1: That
the Chesterton Zoning Map shall be amended showing the rezoning of the
following legally described property from R-2 to B-2:
A parcel of land
in the Northwest Quarter of Section 6, Township 36 North, Range 5 West of
the Second Principal Meridian, more particularly described as follows:
Beginning at the intersection of the North line of said Section 6, with the
West line of the East Half of the Northwest Quarter of said Section 6;
thence South 0 degrees 53 minutes 24 seconds East along said West line,
1105.70 feet more or less to its intersection with the Westerly Right of Way
line of the State Road #49 Bypass, as presently laid out; thence North 11
degrees 51 minutes 00 seconds East along said Westerly Right of Way line
80.18 feet; thence North 15 degrees 17 minutes 01 seconds East along said
Westerly Right of Way line 50.09 feet; thence North 11 degrees 51 minutes 00
seconds East along said Westerly Right of Way line 800.00 feet; thence North
36 degrees 01 minutes 56 seconds West 192.78 feet; thence North 00 degrees
35 minutes 00 seconds West 40.92 feet to the North line of said Section 6;
thence South 89 degrees 25 minutes 00 seconds West along the North line of
said Section 6, 97.31 feet to the point of beginning.
Which property is
commonly known as: 600 East Porter Ave., Chesterton, IN
SECTION 2: That
attached to this Ordinance is a copy of the Written Commitment as proposed
and executed by the Petitioner and approved by the Chesterton Plan
Commission and the same shall be recorded subsequently with the adoption of
this Ordinance and a copy is attached hereto and made a part hereof.
SECTION 3: This
ordinance shall be in full force and effect from and after its adoption and
publication as required by law.
ALL OF WHICH IS
PASSES AND ADOPTED by the Chesterton Town Council, Porter County, Indiana,
this 27th day of June, 2011.
