NOTICE OF PUBLIC HEARING

PROPOSED VARIANCE

Notice is hereby given that the Board of Zoning Appeals of the County of Porter, Indiana, will hold a public hearing on the 21st of April, 2010 at 6:30 p.m. in the Porter County Administration Center, 155 Indiana Avenue, Suite 205, Valparaiso, Indiana, to consider the petition of Kami & Chad Woody, 901 Domke Drive, Valparaiso, seeking Variances from the following Sections of the Unified Development Ordinance: Section 2.14, R-1, District Development Standards Minimum Rear Setback, to reduce the rear setback for an accessory structure from 15 feet to 5 feet; Section 9.04 (B) Nonconforming Structure, Enlarged or Altered, to enlarge a legal non-conforming structure; Section 5.06 AS-03, Accessory Structure; Residential (B) Maximum Floor Area, to increase the maximum cumulative square footage of all accessory structures from 1,300 square feet to 1,640 square feet; and Section 5.06 (C) AS-03, Accessory Structure, Residential, Appearance, for the exterior façade of the accessory structure to match the current accessory structure and side of the house, rather than the house’s front façade; all in order to construct an addition to an existing accessory structure, to be located on the following described property:

Chad C. Woody and Kami J. Woody, f/k/a Kami J. Kraatz, husband and wife, release and quit-claim to Chad C. Woody and Kami J. Woody, husband and wife, for and in consideration of good and valid consideration the receipt whereof is hereby acknowledged, the following Real Estate in Porter County in the State of Indiana, to-wit:

A parcel of land in the Northeast 1/4 of Section 36, Township 35 North, Range 6 West of the Second Principal Meridian in Porter County, Indiana, described as follows: Commencing at the Northwest corner of the Northeast 1/4 of the Northeast 1/4 of said Section 36; thence South 0 degrees East (based upon an assumed bearing of North 89 degrees, 20 minutes West for the North line of said Northeast 1/4 1/4) along the center line of Sagers Road 986.52 feet; thence continuing along said centerline South 27 degrees East 385.10 feet; thence continuing along said centerline South 16 degrees, 38 minutes, 40 seconds East 208.92 feet to the point of beginning; thence continuing along said centerline South 16 degrees, 38 minutes, 40 seconds East 106.45 feet; thence South 89 degrees 51 minutes East 217.0 feet; thence North 00 degrees 09 minutes East 101.90 feet; thence North 89 degrees, 51 minutes West 247.75 feet to the point of beginning; and

A parcel of land in the Southeast Quarter of the Northeast Quarter of Section 36, Township 35 North, Range 6 West of the Second Principal Meridian, in Porter County, Indiana, being more particularly described as follows: Commencing at the Northwest corner of the Northeast Quarter of said Northeast Quarter of Section 36; thence South 00 degrees 00 minutes 00 seconds East (based upon an assumed bearing of North 89 degrees 20 minutes West along the North line of said Northeast Quarter) along the centerline of Sager Road, a distance of 986.52 feet; thence continuing along the centerline of Sager Road South 27 degrees East, a distance of 385.10 feet; thence South 89 degrees 51 minutes East, a distance of 415.00 feet to the Northwest corner of Lot 1 in Woodview South 1st Addition, as per plat thereof, recorded in Plat File 14-C-6 in the Office of the Recorder of Porter County, Indiana; thence South 00 degrees 09 minutes 00 seconds West along the West line of said Lot 1, a distance of 100.00 feet to the Southeast corner of the Rarity Tract, as described in Deed Record 351, page 214 in said Office of the County Recorder, said corner also being the Point of Beginning; thence North 89 degrees 51 minutes 00 seconds West, along the South line of said Rarity Tract, a distance of 106.99 feet; thence South 00 degrees 09 minutes 00 seconds West, a distance of 201.90 feet to the North right-of-way line of Domke Drive in said Woodview South 1st Addition; thence South 89 degrees 51 minutes 00 seconds East along said North right-of-way line, a distance of 110.35 feet to the Southwest corner of said Lot 1 in Woodview South 1st Addition; thence North 00 degrees 48 minutes 12 seconds West along said West line of Lot 1, a distance of 201.93 feet to the Point of Beginning.

GENERAL LOCATION: A parcel of land located at 901 Domke Drive, in Center Township, Porter County, Indiana.

Written suggestions to said proposed Variance(s) may be filed with the Executive Director of the Porter County Plan Commission before such public hearing and/or verbal statements relating thereto will be heard at the above-designated time and place. A copy of the file is available for public view at the Plan Commission office.
