PROPOSED USE
VARIANCE
Notice is hereby given that the
Board of Zoning Appeals of the County of Porter, Indiana, will hold a public
hearing on the 16th of March, 2011 at 6:30 p.m. in the Porter County
Administration Center, 155 Indiana Avenue, Suite 205, Valparaiso, Indiana,
to consider the petition of Michael Tisma, 2503 William Drive, Valparaiso,
seeking a Use Variance from the Unified Development Ordinance: Section 2.11,
requesting a Use Variance to allow a Winery and other commercial activities
in a RR, Rural Residential District, to be located on the following
described parcel of land:

Part of the fractional North Half
of Section 5, Township 35 North, Range 5 West of the Second Principal
Meridian, in Porter County, Indiana, described as follows: Beginning at the
northeast corner thereof; thence South 00 degrees 00 minutes 00 seconds West
653.32 feet, along the East line of said section; thence North 89 degrees 16
minutes 38 seconds West 716.96 feet, along a line parallel with the
East-West centerline of said section, to a point on a line 1930.90 feet East
of and parallel with the North-South centerline of Section 5; thence North
00 degrees 00 minutes 03 seconds East 663.87 feet, along said North-South
parallel line, to the North line of said Section 5; thence South 88 degrees
26 minutes 04 seconds East 717.16 feet to the point of beginning.
Subject to roads, highways,
ditches, drains, easements, covenants and restrictions contained in all
documents of record; all laws, ordinances and governmental regulations
including building and zoning; any state of facts that an accurate survey
might disclose; and real estate taxes and assessments for 2010 payable in
2011 together with delinquency and penalty, if any, and real estate taxes
and assessments due and payable thereafter which the grantee herein assumes
and agrees to pay.
GENERAL LOCATION: A parcel of
land located at 294 East 600 North in Washington Township, Porter County,
Indiana.
Written suggestions to said
proposed Use Variance may be filed with the Executive Director of the Porter
County Plan Commission before such public hearing and/or verbal statements
relating thereto will be heard at the above-designated time and place. A
copy of the file is available for public view at the Plan Commission office.
