DEVELOPMENT ORDINANCE
WHEREAS, the
Porter County Board of Commissioners adopted the Porter County Unified
Development Ordinance; Ordinance No. 07-05 on Tuesday, May 1, 2007; and
WHEREAS, the
Porter County Board of Commissioners has deemed it necessary to amend
Chapter 10; Processes, Permits and Fees; Section 10.02 Telecommunication
Facility Review; Special Exception; of the Porter County Unified Development
Ordinance.
NOW, THEREFORE,
BE IT AND IT IS HEREBY ORDAINED THAT:
Chapter 10:
Processes, Permits and Fees; Section 10.02 Telecommunication Facility
Review; Special Exception
Add the
following:
Notice of Intent:
The applicant shall, on or up to 90 days prior to the scheduled
pre-application meeting, file a letter of intent. The letter of intent shall
include, but not limited to, the following:
1. Name, address
and telephone number of the petitioner, property owner, owner of the
proposed telecommunication facility, intended lessee or user
2. Written
consent or other proof of authorization of the owner of the building,
structure or land to which or on which the proposed facility is to be
erected.
3. Additional
Information; Such other additional information as may be required by the
Plan Commission Office to evaluate the Notice of Intent
Duration:
1. The Notice of
Intent shall expire 90 days after said Notice of Intent has been submitted
and accepted by the Plan Commission Office.

passed and adopted this 16th day of February , 2010.
