PROPOSED VARIANCE

Notice is hereby given that the Board of Zoning Appeals of the County of Porter, Indiana, will hold a public hearing on the 3rd of March, 2010 at 6:30 p.m. in the Porter County Administration Center, 155 Indiana Avenue, Suite 205, Valparaiso, Indiana, to consider the petition of Porter Hospital, LLC, 4000 Meridian Boulevard, Franklin, Tennessee 37067 c/o William A. Ferngren, Ferngren Law Offices, LLC seeking Development Standards Variance(s) from the following sections of the Unified Development Ordinance:

1. 3.06 ARO District Development Standards, (B) Accessory Structure Standards: (2), to allow the construction of an accessory structure NOT to have on all sides the same proportions, architectural features, construction materials of the primary structure, and NOT to be architecturally complementary to the primary structure.

2.3.06 ARO District Development Standards, (C) Architectural Design Standards: (1) Applicability: (c) Fašade: (iv) Four-sided Architecture, to eliminate the requirement of the architectural style, color and design on front elevation to be applied to all elevations of the structure.

Legal Description

Part of the Southeast Quarter and also part of the Southeast Quarter of the Northeast Quarter, all in Section 24, Township 36 North, Range 6 West, Second Principal Meridian, Porter County, Indiana, and being more particularly described as follows:

Commencing at the Southeast corner of said Section 24; thence South 89 degrees 54 minutes 45 seconds West (bearing based upon the record bearing of North 00 degrees 24 minutes 04 seconds West along the East line of the Southeast Quarter of Section 24 as shown on the parent survey by Duneland Group, Inc. being recorded as Document Number 2008-013846 in the Office of the Recorder of Porter County, Indiana), 1223.95 feet on and along the South line of the Southeast Quarter of said Section 24 to the intersection with the West line of 74 acres off the East side of the Southeast Quarter of said Section 24; thence north 00 degrees 22 minutes 46 seconds West, 180.21 feet on and along the West line of said 74 acres to the intersection with the right-of-way line of U.S. Highway 6, and being the point of beginning of this description; thence on and along the right-of-way lines of U.S. Highway 6 and State Road 49 the following fourteen courses: 1) North 89 degrees 52 minutes 42 seconds East, 57.93 feet; 2) thence South 00 degrees 07 minutes 18 seconds East, 50.00 feet; 3) thence North 89 degrees 52 minutes 42 seconds East, 80.00 feet; 4) thence South 89 degrees 47 minutes 07 seconds East, 351.47 feet; 5) thence North 76 degrees 18 minutes 55 seconds East, 218.30 feet; 6) thence North 29 degrees 56 minutes 00 seconds East, 924.51 feet; 7) thence north 06 degrees 54 minutes 57 seconds East, 352.02 feet; 8) thence north 00 degrees 16 minutes 18 seconds West, 480.00 feet; 9) thence South 89 degrees 43 minutes 42 seconds West, 40.00 feet; 10) thence North 00 degrees 16 minutes 18 seconds West, 60.00 feet; 11) thence North 89 degrees 43 minutes 42 seconds East, 40.00 feet; 12) thence North 00 degrees 16 minutes 18 seconds West, 160.00 feet; 13) thence North 01 degrees 59 minutes 35 seconds East, 200.16 feet; 14) thence North 00 degrees 23 minutes 23 seconds West, 1747.55 feet to the intersection with the North line of the Southeast Quarter of the Northeast Quarter of said Section 24; thence South 89 degrees 49 minutes 29 seconds West, 1321.70 feet on and along the North line of said Quarter-Quarter Section to the Northwest corner of said Quarter-Quarter Section; thence South 00 degrees 23 minutes 39 seconds East, 1325.39 feet on and along the West line of said Quarter-Quarter section to the Southwest corner of said Quarter-Quarter Section; thence North 89 degrees 50 minutes 24 seconds East, 99.15 feet on and along the South line of said Quarter-Quarter Section to the intersection with the West line of said 74 acres; thence South 00 degrees 22 minutes 46 seconds East, 2469.73 feet on and along the West line of said 74 acres to the point of beginning, containing 104.43 acres, more or less.

GENERAL LOCATION: A parcel of land located at the Northwest corner of U.S. Highway 6 and SR 49 in Liberty Township, Porter County, Indiana.

Written suggestions to said proposed zoning amendment may be filed with the Executive Director of the Porter County Plan Commission before such public hearing and/or verbal statements relating thereto will be heard at the above-designated time and place. A copy of the file is available for public view at the Plan Commission office.
